This End User License Agreement applies only to the Cymru application, which can be accessed at https://cymru.pages.dev. The open source version, Scriptwriter Pro, which can be accessed at https://scriptwriterpro.pages.dev, is governed by the Barclay Public License, which can be found at https://github.com/BarclaySoftware/scriptwriter?tab=License-1-ov-file.
This End User License Agreement (“License”) contains provisions that apply to your access to and use of our browser-based application and all downloadable and/or installable software (collectively, the “Software”) published by Jupiter Group dba Cymru (“Cymru”, “Scriptwriter”, “we”, “us”, or our"), except for any software or applications you use or download through an interface taht includes a different end user license agreement.
Cymru’s Terms of Service (“Terms”), which can be found at https://cymru.pages.dev/support/legal/terms-of-service, form an integral part of this License. For purposes of this License, references in the Terms to “Services” shall be deemed references to the Software, and this License applies where the software is accessed or used over the internet through a browser or similar interface.
By accessing, visiting, downloading content from, copying, or using the Software, you agree to accept to be bound by (1) this License and (2) the Terms at all times. If you do not agree with either of these, please do not access, visit, download content from, copy, or use the Software.
Cymru reserves the right to change, modify, add, or delete provisions from this License at any time, as more particularly described in the Terms.
YOUR LICENSE TO USE THE SOFTWARE
You may use the Software strictly in accordance with this License, including the Terms incorporated herein. We reserve the right, at any time and in our sole discretion, to update, modify, replace, suspend, discontinue, or otherwise change the Software (including any features, functions, user interface, integrations, or availability) from our systems.
Cymru grants you a non-exclusive, non-transferable, non-sublicensable, personal, limited license, revocable at any time at our sole discretion, to: access and use the Software over the internet (including through a web browser, mobile application, or other online interface) (“Web & Mobile Software”) in accordance with this end user license agreement and, where applicable, the Barclay Public License. Different licenses have different restrictions on the usage allowed and/or the scope of permitted access to Web & Mobile Software.
Updates, upgrades, patches, and modifications may be necessary in order to be able to continue to use the Software on certain browsers or environments, and we may require you to adopt updated versions of the supported browsers/devices to continue using the Software. THE SOFTWARE IS LICENSED TO YOU, NOT SOLD.
Except for the rights explicitly granted in this License, Cymru retains all right, title and interest (including all intellectual property rights) in the Software and user documentation, including the Software made available to you over the web and mobile applications. Cymru may use third-party software that is subject to open source or third-party license terms. You are subject to those terms. User documentation is available on the Cymru website.
The foregoing notwithstanding, Cymru retains ownership of all intellectual property rights in and to the Software, including copies, improvements, enhancements, derivative works and modifications thereof unless made to the open source Scriptwriter Pro, which may be incorporated into this product. Your rights to use the Software are limited to those expressly granted by this License. No other rights with respect to the Software or any related intellectual property rights are granted or implied. CYMRU MAKES NO INTELLECTUAL PROPERTY OR COPYRIGHT CLAIMS OVER YOUR UNIQUE SCRIPTS.
YOUR RESPONSIBILITY TO PROTECT YOUR CONTENT
You are solely responsible for maintaining appropriate security measures, including using additional encryption technology to protect your content from unauthorized access and disclosure, and for keeping backup copies of all content. Cymru has no responsibility or liability for deletion, corruption or other damage to or loss of content, including content stored locally on your device, transmitted over the internet, or stored within Web & Mobile Software, except to the extent expressly provided otherwise in the Terms.
PRIVACY
When you use the Software (including Web & Mobile Software), you and we are subject to our Privacy Policy. Please review our Privacy Policy carefully as it explains what information we collect from you.
SOFTWARE PIRACY
Cymru is a commercialization of the libre Scriptwriter Pro project, both developed by Barclay Software, a division of the Jupiter Group. The base source code, and core components of Cymru, are available under the Barclay Public License. Proprietary source code is only proprietary due to its experimental or sensitive nature. As such, we consider it impossible or abnormal for software piracy to occur. Users are both free and encouraged to review the Scriptwriter Pro source code and make modifications to it. Please access the source code from the official GitHub Page (https://github.com/BarclaySoftware/scriptwriter).
ACCEPTABLE USE
Please refer to the Acceptable Use set forth in the Terms.
INFRINGEMENT
You and Cymru acknowledge and agree that, in the event of a third-party claim that your possession or use of the Software infringes any third-party’s intellectual property rights, you (and not Cymru) will be responsible for the investigation, defense, settlement and discharge of any such claim of intellectual property infringement.
ACCESS TO SOFTWARE
The Software is available to all users free of charge and without requirement for account registration. You may use the Software on as many computers as you wish for any purpose, so long as the Software is not used for illegal purposes (including but not limited to: copyright or intellectual property infringement). Cymru makes no distinction between individuals, corporations, students, or any other type of user and all access is guaranteed for each type of party.
An internet connection and desktop or tablet device will be required to use the Software.
